Copyright & DMCA Policy

Examiniser respects the intellectual property rights of others and expects users to do the same. This policy explains how to report alleged copyright infringement under the US Digital Millennium Copyright Act (DMCA) and UK law, how to submit a counter-notice, and how Examiniser handles exam-paper content and repeat infringement.

Our commitment

All original Examiniser content — including the website design, branding, code, generated maths questions, and editor — is created by the site owner or its licensors. Exam-board past papers made available via Examiniser (for example AQA, Edexcel and OCR) remain the property of their respective owners and are made available for educational practice. If you are a rights holder and believe material on Examiniser infringes your copyright, we will act promptly upon receiving a valid notice.

This policy supplements the Intellectual Property and Acceptable Use sections of our Terms of Use. Nothing in this policy constitutes legal advice.

Designated Copyright Agent

All copyright notices, counter-notices and related enquiries should be sent to our Designated Copyright Agent:

If you are a UK rights holder, you may also rely on the same contact for notices under the UK Copyright, Designs and Patents Act 1988 and the E-Commerce Regulations 2002.

  • Email: examiniser@gmail.com (preferred method — include 'Copyright Notice' or 'DMCA Notice' in the subject line)
  • Subject line example: DMCA Takedown Notice — [Work title / URL]
  • Examiniser is operated by a solo developer, so response times may vary. We aim to acknowledge valid notices within 7-10 business days. For fastest handling, please use email and include all information listed below. All notices are reviewed manually.

How to submit a takedown notice

To be effective under 17 U.S.C. § 512(c)(3), a takedown notice must include substantially the following. Notices that are incomplete may not be acted upon:

Please send the notice from an email address that matches your organisational domain where possible, and attach evidence of ownership if available (for example a link to the original publication). We may request additional verification before acting.

  • 1. Identification of the copyrighted work claimed to have been infringed — for example the title, exam board, paper, year and, if available, registration or publication details. If multiple works are covered, provide a representative list.
  • 2. Identification of the material claimed to be infringing, with enough detail for us to locate it — the exact URL on https://examiniser.com (for example https://examiniser.com/en/exam-papers/viewer?source=aqa&level=secondary&year=2024&paper=paper-1&tier=foundation&type=question) and a description of where the material appears on that page.
  • 3. Your contact information — full legal name, organisation (if applicable), postal address, telephone number, and email address.
  • 4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • 5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the owner.
  • 6. Your physical or electronic signature (typing your full legal name at the end of the email satisfies the electronic signature requirement).

What happens after we receive a notice

Upon receipt of a substantially compliant notice, Examiniser will: (a) promptly review the claim, (b) remove or disable access to the allegedly infringing material where appropriate, and (c) notify the affected user or the exam-paper source if the content was provided under licence.

We aim to act within 2–5 business days, and sooner where the hosted material is clearly third-party past-paper PDFs served from our CDN (https://d2lpkm1h3gh3rw.cloudfront.net). Removed material will remain disabled pending resolution or counter-notice. We will also inform you if we require further information or if the notice is deficient.

If you misrepresent that material is infringing, you may be liable for damages under 17 U.S.C. § 512(f) or equivalent UK law. Please consider whether the use may be authorised, licensed, or constitutes fair dealing / fair use before submitting a notice.

Counter-notice (if your content was removed)

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notice to the same agent (examiniser@gmail.com) with the following:

Upon receipt of a valid counter-notice, we will forward it to the original complainant. Unless the complainant notifies us within 10–14 business days that it has filed an action seeking a court order, we may restore the material at our discretion.

  • 1. Identification of the material that was removed or disabled and the URL where it previously appeared.
  • 2. Your contact information — full legal name, postal address, telephone number, and email address.
  • 3. A statement under penalty of perjury that you have a good-faith belief that the removal or disabling was a result of mistake or misidentification.
  • 4. A statement that you consent to the jurisdiction of the courts of England and Wales (and, for US DMCA purposes, the Federal District Court for the judicial district in which your address is located, or if outside the US, any judicial district where Examiniser may be found) and that you will accept service of process from the complainant.
  • 5. Your physical or electronic signature.

Repeat infringer policy

Examiniser may, in appropriate circumstances and at its sole discretion, terminate or suspend accounts of users who repeatedly infringe the copyright of others. This includes teachers or organisations that repeatedly upload or distribute infringing material via homework, exam papers, or classroom content in violation of the Acceptable Use and User Content sections of our Terms.

We also reserve the right to remove past-paper sets or CDN assets prospectively if we receive multiple valid notices concerning the same exam-board source.

Exam-board past papers

Past papers from AQA, Edexcel, OCR and other boards displayed via our exam-papers viewer are provided for educational practice. Where papers are hosted on our CDN, they are included in good faith for revision purposes. If you represent an exam board and wish to discuss licensing, attribution, or removal of specific papers or years, please contact examiniser@gmail.com with the subject 'Exam Board Licensing — [Board Name]' and we will respond promptly to arrange a suitable solution (for example updated attribution, link-out instead of host, or removal).

New exam-board sources are currently commented out (Baccalauréat, Selectividad, Gaokao) and are not served until licensing is clarified.

UK law and other jurisdictions

Although this policy is framed for the US DMCA, Examiniser is operated from the United Kingdom and honours equivalent notices under the UK Copyright, Designs and Patents Act 1988 and the Electronic Commerce (EC Directive) Regulations 2002. Notices from rights holders outside the US are handled on the same terms using the same agent and email above. Nothing in this policy affects rights or defences under applicable national law, including fair dealing in the UK.

Changes to this policy

This policy may be updated as the site or the law changes. Material changes will be reflected on this page with an updated 'Last updated' date. Your continued use of the site after changes constitutes acceptance of the updated policy.
